Will my hubby have to pay back child support for 17 year old? (just found out about the child)

The boy's mom decided to file on my hubby about 5 months ago.

The child pre-dates my marriage--I just don't want my hard earned money to leave my household--we have 2 small kids.

  1. Depends on your state laws.  Here in VA, you can only get back child support to the date you originally filed for support.  (example - my son was born in Oct, but I didn't file until January, so the back support that is owed is from January on.)


  2. There should be a state agency regarding child support that you could ask, or I think it would be worth it, even if you had to pay for an hour of time, to contact and go to a lawyer about it.  You also need to petition for a dna test.

  5. Honestly I would say it depends upon how good your lawyer is and how bad his is.  Laws vary by states, it depends upon how long you've known the child was his and what efforts you've made to find him.  Good luck!

  6. If some woman is just telling him about a child that's his after 17 years, SHE should be obligated to pay him and the child for such deception.  On top of that, she wins worst mother of the year award.

    I have a family friend that found out he had a daughter...  When she was a senior in highschool!  

    Apparently the mother married a man when she was pregnant and told him the baby was his.  He raised this girl until she became ill and needed a blood transfusion as well as bone marrow.  Of course the doctors did testing to see if the parents could be a  possible match...  Well you guessed it, the father was not her father and he was devistated and left.  

    So now the mother came after my friend for child support.  The judge ordererd him to pay for the past 3 years!  He didn't even know she existed because of the mother!  And he has a wife and kids to support as well as this daughter that hates him because of the mother and her lies....  

    My suggetion to you is hire a good lawyer!

It depends on what state you live in.  Every state handles the awarding of back support differently.  Some do go all the way back to birth, some will only go back 1-5 years, some only go back to the date the court papers were filed, some NEVER award back support, and still other's leave it entirely up to the judge.  So I need to know your state to give you the most accurate answer.  

    Here is a very good link, find your state.  It is a link for a brief overview of each states child support laws.  There is a lot of helpful info. in there, but for now what you want is the "support order establishment" section.  And the questions "Will your State establish support orders for prior periods?" & directly under that "If so, for what prior periods (e.g., birth of the child, date of separation, prenatal expenses, 5 years retroactive)?".  The answers there will give you your answer.  Good luck.

I wouldnt say so b/c he didnt know about the child....it also depends on if his name is on the Birth Cert.  I doubt it is seein as he didnt know abou the child so I would say no!  Is the childs mother saying he has to?  If so he needs to either contact the child support office and find out or consult a lawyer!

  10. most likely yes most likely if they did a blood test and his name is on the birth certificate. but your husbands money from his pay checks would be taken out not yours unless your not working but there is no choice of yours he has to pay child support if the courts say he has to there is no way around it and if he doesn't pay he may face more troubles

  11. Here, in Georgia, it is only owed from the time it was originally filed. Example: If this case where in GA, he would only be paying now until the child turned 18- less than a year.
