Question:

Will my husband contest our divorce?

1. I can't get him to speak about the divorce. He has said he wants one before, but won't go file because he is "researching". I said I'm going to do it he said "I'll go, not you".

2. He pays me child support very sporadically, here and there.

3. His mom said now he said he dont want one, but I'm pretty sure he had an emotional affair or more with an old 250 lb friend who was obsessed with him

4. I told him I need his part of the retainer/court fees by this Monday, I want to file Tuesday. He won't respond. His mom said he wants to be left alone about it.

What is going on here?

Just file yourself and don't worry about working it out with him.  It's sometimes best to let the attorneys do all the talking in a divorce case.  The process can become stressful and ugly and it's best if you can avoid all that.  Your attorney will draft the petition and it will be served to your husband.  He will have the opportunity to respond and counter the petition.  His attorney will handle all that and give the info back to your attorney.  If you aren't speaking and aren't in 100% agreement, you'll have to have two attorneys anyway.  One attorney can't represent both of you unless you completely agree on everything and none of the terms are disputed.  Why fight, argue and add stress where it isn't necessary?

  4. It sounds like he doesn't really want the divorce, and you do. Just maybe give it some time, keep going with the proceedings if that is what you definitely want to do or else possibly reconsider if he wants to work things out.  

  5. the first person who files child support is better that you do it..you ask for child support and any other things that you need, he will have 30 days to respond to the divorce complaint..just go ahead and file, let him deal with his reactions.

  6. just file it and he will have to respond or you can get as much as you ask for in child support if he isn't going to show up. They will take the child support directly out of his check if he doesn't pay it.

  7. Strike first.. file yourself, file for child support (they'll take it right out of his check)  The court will tell him what costs he has to pay. If you have to pay for all of it who cares? Divorce him and move on, he's playing with your head.

  8. um..why are you asking us?
