  1. No, it will go towards the balance up to the amount he owes. Do you file jointly? If so, keep in mind that you can file an injured spouse claim to keep your portion of the refund from going to his debt.

  2. Duh, No.

  3. The stimulus payment is treated the same as any refund for offsets, so if he owes something that his refunds are taken for, his stimulus payment will be taken also.

  4. I have some clients who owe taxes from previous years.  Instead of getting a check, they got a letter from IRS telling them to what year their payment was being applied.  You will too.

  5. He sure won't. It will go towards paying off what he owes. If there is anything remaining he will be sent that. He should feel lucky that he doesn't have to use his own money to pay it. This is like free money.

  6. NO! The Stimulus as well as all future refund will be offset to the debt until account is full paid, which will take forever because interest and penalties continue to accrue until full paid.

  7. If he diren't receive a refund check and he still owes money to the IRS they would just keep the money of the stimulus and put that towards his debt.
