Will my insurance cover car damage if...?

1) If I let someone who isn't on my car insurance and they don't have car insurance drive my car. 2) What if they do have car insurance on their vehicle and they wreck mine? 3) What happens if they get hurt in all situations?

  1. In most USA states, and for most policy's, anyone who has permission to drive an insured vehicle and has a valid drivers license is covered.  If he has insurance, Your insurance would be primary and his secondary


  2. if they had your permission to drive at the time of loss they are covered.  insurance follows the vehicle- meaning your company is primary for the damage- if he has insurance his company id secondary if you dont have enough coverage.  if you have injury coverage (pip or med pay) on you policy there will be coverage for the drivers injury

  3. In most US states, if you give somebody permission to use your vehicle, and they are not a regular user, both you and the driver are covered.  

    If they damage your vehicle, and they have Collision coverage of their own, their insurance MAY cover your vehicle.  However, this is doubtful.   If you have Collision coverage on your vehicle, then your insurance will pay for the damage to your vehicle.

    If the driver of your vehicle is injured, they may have a claim against the other party involved in the accident.  If you have PIP or Medical Payment coverage, then the driver is entitled to this coverage under your policy.  If they drivers is at-fault, he is simply barred from recovery.   He has no direct claim against you.

    If the other party is uninsured or underinsured, it depends on your policy and the driver's policy as to which coverage is primary.  In some states, these coverages follow the person, not the vehicle.
