Will my sister in law go to jail?

My sister in law is 5 months pregnant and she got caught stealing like $50 from a lady at an assisted living home. She has two little ones at home, what are they going to do to her. I think it is a Class 4 felony. She is in Colorado.

  4. If your sister has no priors at all, a $50 theft charge is considered petit theft in itself. If this is the only charge, it would be unlikely for her to be incarcerated. More than likely, a fine, restitution and probation.

    The main point here is that there is only ONE charge of petit theft. If there is burglary, assault, breaking and entering, etc, it adds to the possibility of additional time.

    PS...the fact that she is pregnant and has children at home is not a factor in the eyes of the law. The children (in a worst case scenario) would be given the opportunity to go with their father, any member of the family that would take them or to the state if needed.

  5. She will need a lawyer.  The lawyer will most likely make a deal where she serves no jail time.  Stealing from a person living in an assisted living home ... the only non-violent crime I can think of that is lower is stealing candy from a baby!

  6. What kind of person is your sister? An old lady was victim to her greed. I hope she goes to jail and her kids taken from her as her example is no good for her kids.

  7. She won't go to jail but she'll be charged with some sort of theft based on the amount she stole.  Most likely, she'll get probation because this is a first offense and will probably have to pay court costs and restitution. Of course, she'll get fired if that's where she worked.
