  1. No, always ask an attorney when in doubt.  Debts can be tricky and you don't want to end up with a huge amount.  Unless he is physically disabled, he will still have to pay an amount at some point in time.


  2. No, let the judge decide.  Your spouse wont always be unemployed.  The courts usually ask for previous tax statments to decide.
