Will my spouse be granted as a permanent resident if she marry me???

I'm currently holding an asylum status, and trying to adjust it to a permanent resident status. I have a gf that is planning to marry me and she holds a status of an international student. When we do get married, will she obtain the asylum status or just as a resident status??? we are so confused.... thanks for all the help....

  1. You will have to adjust status to an LPR before your spouse will be able to receive that status.

Sorry but marrying a permanent resident does not give permanent residence to the spouse.  Only if you are a US citizen can you gain permanent residence automatically.  You fiancee will have to go back to her country when her F-1 expires, specially because you are not a permanent resident yet.  She will have to arrange her own stay in the US without you.  She can probably try getting a sponsored job since she has a US college education.  Good Luck!!

  3. yes, when a immigrant marrys somone from the states they atamaticly get a green card...i know this because my aunt married someone from peru...good luck...: )

  4. Here's your problem.... even if you get a green card, and get married, there's a wait of about 5 and 1/2 years before your wife can get an immigrant visa.  The spouse of a green card holder does not qualify for a non-quota visa, only the spouse of a US citizen.

    So, when your wife's F-1 expires she has to leave and wait in her own country.


  5. If you're currently in asylum status, your girl friend would not be eligible for any immigration status based on your marriage. You would have had to have been married before you received asylum status for her to benefit from your status. As noted, once you become a legal permanent resident, you could file an immigrant petition for her under the F2a category, but that petition would take 5 years before it becomes valid, so if she tried to stay while waiting for your petition, she would be here illegally. Maybe you should consult one of the NGOs that help asylees and refugees, like Catholic Relief Services or Lutheran World Services, so they can walk you through it.

    Are you a green card holder?  If so, you may marry and petition immigration for your girlfriend/spouse.

    If you are not a green card holder, your girlfriend will have to apply to immigrate on her own.

    Green Card Holders are allowed to petition for a spouse and/or child.
