Question:

Will negligence cancel my homeowner's policy?

Hey all... I recently remodeled my bathroom which included new sinks. Problem is that they were hooked up incorrectly and have caused a major leak/flooding in my house. Is it wise to inform my homeowner insurance adjuster of the recent work, or will this be considered negligence on my part? If is it negligence, can they refuse to pay for damages? The remodeler is a local guy and if need be, I will have to sue him, but in the meantime, do I stay silent on the remodeling or let them know it was my fault? Thanks!

  1. .    Normally you call the agent. This is not negligence on your part.  You would collect.  New carpet and maybe even baseboards.

The recent worries about mold force every home seller to disclose if they have had an insurance claim for water leaks.  If you don't contact your agent, you can truthfully say NO.

  2. IF you did not use a licenced plumber, say nothing to the insurance, If he was licenced, turn him over to your insurance when you file the claim.

  3.    Your contractual obligation  is to fully inform the insurance company of all relevant facts.

Your insurance contract provides  coverage spelled out under your insurance terms.

Even if you personally improperly hooked up your plumbing, any plumbing incompetence does not interfere with policy coverage.

The insurance company will decide if it wants  reimbursement from your remodeler/or remodelers insurance carrier.

I fail to see how this was your fault, but unless intentionally done to create damage, your

insurance rights have not been compromised.

Advise them of the remodeling and be prepared to share the name of tre-modelerler.

It will not matter if YOU were the remodeler.

  4. There was negligence, but the contractor, not you.   They will pay and then sue your contractor.  You are OK.
