Question:

Will the state drop the charges if it is my first offense?

I live in Hawaii, and my ex got me arrested for "abuse of a family or household member." I have never gotten arrested before, and this is just his way of getting revenge and trying to taint my image. I am a school teacher, and this can affect my ability to get license. The allegations are totally false, but I am very scared/concerned about how this will affect my career with children. How likely is it that the charges will be dropped? Am I now considered a "criminal"?

  1. You are considered being charged with it, however until it goes to court, its hard to say.  These marital or relationship battles are so angry and demeaning to both sides, its  just a shame.  Its just too bad you two can't get along.

That said, I would get a GOOD attorney, be prepared to spend money to defend yourself, and approach this seriously.  If it stays on your record and the charges are NOT dismissed, you are in for a battle.  I am not taking sides and attempting to determine who is right here, merely suggesting that you prepare  yourself for a legal battle that is coming and NOT ignore it nor assume the best.

These are serious charges and can have serious long term consequences.

  2. Depends on how strong a case is presented and your defense.

It will also depend on the judge and his attitude  the day of court.

You won't be considered a criminal unless you are convicted of the crime

  3. Get a lawyer go to court, who knows what mood the judge will be in.

  4. Well you are innocent until proving guilty. If it is your first charge, probation and fine. Once you complete probation then you go to the court house and do act 31. Or ask for petion to seal.
