Will they give me a hard time in the embassy?

yes, i did apply for a change of visa in the USCIS here in Florida, from B1/B2 to F1... they approved me. now, if i go back to the philippines for a vacation before class starts, will they give me a hard time in the embassy? why do i need to go there anyway? and is there a possibility that they might not allow me to come back to the US?

  1. Status and a VISA are two different things. If the embassy provide you with a B1/B2 tourist visa it's becuase you showed you have STRONG tides and have satisfied the consular person questioning. Changing the status to F1 in the USA is one thing, getting a F1visa is another thing but they go together. In other words, if you are in a F1 Status then that means you are allowed to study, BUT if you leave you won't be able to get in because you don't have a F1 VISA and your status ended the day you left the country. Now getting back with a B1 visa would would get you in trouble, because first of all lets' say the border agent gives you green light, then NOW you have to change from F1 back to B1, so that means you have to readjust your status back to F1 but I HARDLY think that would happen twice.


  2. You have to go back because you swore you would when you got your B1/B2 visa. You should have no problems at the embassy or returning to the US. At one time you would have been allowed to stay in the US and go to school. The major problem is people who come here on a B1 visa get married and then think they can stay here forever. Now the government is cracking down and you just got stuck in a technicality. The law states that you can not change status on a tourist visa.
