Will this teacher be fired? Suspended?

Special Ed. teacher acccused of mental/physical mistreatment of students. I have researched the district ethics policies and according to them the teacher should be dismissed, however this teacher is related to several people in district administration. Is it unlawful for the district to retain this teacher solely on relation? Where can I find more info on these types of laws?

  1. first of all the teacher should be reported to the police, not just the district administration, and if the teacher did something that is against policies and should be dismissed due to their actions, it is illegal that the teacher is still employed. related or not, that is not a guarantee for any job, especially if they are abusing people. mental or physical abuse. this mistreatment should be taken to the police and to health and human services


  2. The abuse or mistreatment must be documented. Were there direct violations of the students' IEP? If so, those must be noted. When my son was having problems with a particular teacher, it took four months of documenting things such as denial of access to content mastery resources, failure to modify tests, not applying specific criteria, failure to give notes in return for notes, etc. I kept copies on a calendar and then when I had enough, I wrote out the day by day accounts, copied it to the building principal, the district superintendent and the teacher. Things changed after that. Most teachers are on contract and can't be dismissed without some type of formal proceeding taking place. If you believe that her job is being held due to her familial relationships, you can go to the state and file a complaint against all parties involved.

  3. Write down everything that's happened and take it wiht you to a school board meeting and give them the letter. Everything about this needs to be in writing.

    Also write a letter to be put in the newspaper.

  5. Any teacher accused of mental/physical mistreatment SHOULD be fired pending an investigation. The problem with many school districts is exactly what you stated, relatives who sit on school boards and such. This is particularly so in small districts. Is it right? Absolutely not!

    You have done your research. If you feel sure that this teacher did in fact break these policies, attend school board meetings until you get the resolve you wish.

    Unfortunately, a fair and correct discipline will not always happen. In our district a teacher who had been with the district for over 20 years was caught drinking with students at a party. There was no denying it by any of those involved. This teacher attended AA upon being caught and in fact retained his job, pay and benefits! What an outrage! I wish you luck and I am sorry for the abuse sustained by you or your loved one. It is despicable!

  6. Keep notes--dates, description of mistreatment.

    Put your concerns in writing, send it to your principal, the superintendent, and the school board president. Keep a copy for yourself.

    There is policy and procedure for dismissal of a teacher and the union does get involved. It is very difficult for a teacher to be fired, but your concerns should definitely be addressed quickly.

    If your district drags its feet, contact your state department of ed and file a complaint. They must immediately act upon it.
