Me and my mom are going to rent a car there. Can I drive it? I have a Texas learner's permit, and I'm 16. My mom has a Texas driver's license, and is old enough.

And I want to be legal :)

  1. You have to follow the rules for BOTH states:

When you obtain a legal permit from your home state, it is legal in ANY state, plus the US Virgin Islands and Puerto Rico.

But... if you are in a state which does not allow people with learner's permit say, after "dark", then you must follow those rules. More or less the same as the speed limit rules, which vary from state to state.

But, more importantly, when your mom rents a car, the insurance company will probably (almost definitely) not add you as an authorized driver (unless they have an employee who is not on the ball, which is entirely possible).

This means that, your mom could let you drive, and in case you got pulled over, you would not be listed as an authorized driver. Which means you would not be covered by the rental company's insurance. Damages would not be covered in case of an accident, and in some states, if you got pulled over, the car would be impounded, and you would be arrested. I know of one example of a state that has this strict of a law: Georgia.

Bottom line: in your mom's car, you would be ok. In a rental car, probably not.
