Question:

With a 10 year B1/B2 visa normal amount of stay allowed in the US is a little over 6 months.

My question is that does this 6 months period start for the date of entry to the US? If is does, then is it okay if after I fill up the 6 months and I leave for day or a week and then immediately return to the US? Does my 6 months start all over again?

  1. A B2 visa is a visitor visa.  The maximum length of stay the CBP Officer can give you is 180 days.  Leaving for a week or two, and then trying to come back, will signal the CBP Officer that you are trying to live in the United States.  Pulling a trick like that will get your visa canceled and get you deported.  Additionally, a file will be opened on you making it much harder to get another visa in the future.

    After your 180 days are up you should leave, without overstaying, and plan on being outside the United States a minimum of 6 months before trying to come back.


  2. The maximum 6 months of day starts on your arrival. However, at the Port of Entry to US when you enter, you will be given I-94 with the duration of your stay. It could be full 6 months or less depends on the immigration officer.

    You cannot over stay, not even 1 day over, than the date on I-94.

    And you cannot go out of US one week and come back to US. I mean you could try, but more likely you will get either much less than 6 months of stay on your new I-94 or get denied of entry. Immigration Officer has total authority to give you any duration on I-94 based on their judgment.

When you come into the US on a B1/B2, you are usually given an entry stamp for a period of up to 6 months.  During your stay you are allowed to file for an extension giving you a maximum stay of 1 year. So if you came in and got a 6 month stamp you would apply for a 6 month extension.  The funny thing is, processing for the extension application can often take 3-5 months, so people file for it a few weeks before their I94 expires and just wait for an answer, usually by the time the application is processed you have stayed for the amount of time you asked for. However, you do then have to leave. The premise of the B1/B2 visa is that you spend more time in your home country than in the US.  My parents have been coming here on a B1/B2 visa for about 5 years now, and they have used the extension a couple of times to get the full year, they do always make sure that they go back to the UK for 3-4 months though.  They own a house in FL and like to spend the winter there.  If you come for 6 months and then go out for a week and then come back in you may get another 6 months, if that is your first time doing it - but why pay the airfare, just file for the extension.... you will only get away with that a couple of times, eventually you will have to spend an extended period out of the US.
