Woman claims she broke her tooth on a hamburger i served her????

my boss had just called me about this woman that called saying she broke her tooth on a hamburger she had eaten last week at the restaurant wich i work at. the thing was, it wasnt last week she came in, it was 2 weeks ago. and she claims she told me she broke her tooth wen really i went to her table and she had one bite of the burger and said there was a bone in it. she didnt tell me she broke her tooth or anything. i asked her if she wanted anything else instead and she said no. she was drinking some kind of alcoholic drink, cant remember wat tho and so i ended up takeing the burger off her bill. and now she calls, two weeks later and complains to my boss about it and he calls me. can i get in trouble for this? i mean wat can happen? can she sue? why are peeple this stupid? i meen wat was i supposed to do , eat the burger b4 i gave it to her to make sure it was ok? jesus with peeple these days if they dont like it & want 2 complain then stay home & cook. wat can happen becuz of this?

  1. Anyone can sue over anything. It doesn't sound to me like she has any real evidence. Did she keep the burger? It depends on your boss. Worst case scenario is if she has evidence and they think she can do something about it they may make you the scapegoat and fire you. I would think any liability would be the restaurant's. I don't think you brought that hamburger meat from home. If you were doing your job how they taught you I don't know how they could really hold you responsible.

    If she was drinking and she doesn't have her facts straight I don't know how she could do anything about it. Is it your restaurant's fault she has weak teeth?

    Also it seems like you did your best to rectify the situation when it happened. If she was not happy she should have asked for the manager then.

  2. People!!! will do anything, to sue!! she really has no foot to stand on, do not worry about it, its done more than you know!!! and their are people out there, that know all the tricks, I was in the business for 44 years, and I have seen it all!!!!

  3. some responder said you could be fired as a scapegoat............understand you cant and the legal bills for that would be enourmous for the company,as a server,you simply served the product.didnt buy it,cook it,plant anything in it.the woman is going to settle with your restaraunt,thru the insurance co.the insurance co will pay her something,as it cost too much to fight it out in court.in civil cases like this.....the woman doesnt have to PROVE she broke her tooth,the business has to PROVE she didnt.and thats impossible.thats why insurance is so expensive-b/c of ppl like her,who broke her tooth at home and is now trying to get someone to pay her bills.it happens a hundred times a day.

    Just kidding...if her tooth broke while eating the burger she should have disclosed that to you at the time.  Unfortunately if she had decay then it would only have been a matter of time before it fractured anyway...whether it was on your burger or on an apple or a peice of bread.

  6. If I were you, I wouldn't worry too much, If she does try to sue you or anything, again nothing to worry about. You havn't done anything wrong. If she didn't tell you on the day how can you be sure she broke her tooth in your restaurant?
