Question:

Won a car on eBay, paid 2-3 months later, the seller agreed. but does not want to give me the car. can i sue?

i won the car but didnt have the money right away. the listing said to pay in 3 days but i talked to the seller and they said they will wait. i paid about $2925 with in the month. then it took me another month to pay the rest. the total amount was $10,025.00. i have the recipts for three payment that complet the full amount of the payment. the ad states how much i won the car for it was $9,800.00 + 125 documents. plus i pay them $100 for late fee. so i talked to the seller, thay told me that the money was ther so i told them that im going to call the tow truck driver. when the tow truck arived to pick my car up he called me saying that the seller doesnt want to give him the car because i still owe $1,000 in storage fees, i talked to the seller, thay told me thay send me a massage a month ago, then they sied NO A WEEK AGO, so now i know there lieing. i go check my messages and they send the message right when my tow truck guy got there. Can i sue to get my $10,025 dollers back?

  1. If you were not told about any storage fees ahead of time, they cannot charge you. If you have documentation proving that you paid in full, then they are obligated by law to either release the car to you or return 100% of the money you paid them. If they will not do either of those things, I'd say to call the police non-emergency number first and ask what to do. If they cannot not help you, then yes you should sue. As long as you have all the proper paperwork to prove you made payments and never received the car, you will win.


  2. File a dispute with Ebay...it's the only way to resolve it.

  3. Not likely.  You defaulted by not paying in 3 days as the listing said to do, even though the seller agreed to give you some time, he does have the right to charge extra for storage.

    In reality, he is only charging $15 a day storage, which is not excessive.  You can sue if you'd like to, or go to eBay arbitration, but it would probably be easier to pay the storage and get your car.
