is it illegal for an employer to cancel health insurance and not inform the employees....the owner of my company cancelled our health insurance and didnt tell anyone anything...i didnt find out until i got paid and realized that they hadnt taken out medical insurance from my check?? I didnt mention it because i figured we were switching health insurance compaines and it will probably we taken out for 2 months on my next check but still nothing.......can he do that without informing us?

  1. Have you spoken with your companies HR department about it?

    I'd just give them a call and let them know that you noticed that the premium for the health insurance was not taken out and you wondered what was going on.


  2. No, it's not.  He can do that.

    At worst, they're on the hook for any claims that WOULD have been paid, until you are notified.

    But start looking for another job - when he stops paying the health insurance, it's not going to be long before he can't make payroll.

  3. well.. yes and no.. the company HAS to legally notify you of your COBRA rights.. but,

    if the company is:

    1) is no longer offering health insurance at ALL

    2) filing bankruptcy

    3) goes under for any reason whatsoever

    then there will be NO insurance for you to continue; therefore, there will be no COBRA rights to advise you of. is what they are doing shiesty? absolutely. is it illegal? no.
