Worked for a contractor who didn't have me fill out a 1099?

I did some work for a contractor and was paid $5,100. This was all spent on material but they still want to 1099 me. I don't feel comfortable giving them my social because they seem to be ripping people off. Do I legally have to give it to them? They didn't have me fill out any paperwork before or after. I am going to report the money to the irs on my own but I dont want them to have my social. Any help would be great.

  1. You must report this income on your tax return even if you do not get 1099-Misc.

    It will be reported on schedule C or C-EZ (Form 1040). On this you can also deduct all your business related expenses.

  2. Technically, no but you should.

    The employer is required to issue Form 1099-Misc to individual subcontractors who are paid over $600.

    There's no difference between getting a wage earning job in which the employer has you fill out an application form with your social security number once hired between an employer who hired as an independent contractor who asks you for "proper" ID for their business records.

    Also, the IRS and INS (Immigration and Naturalization Service) is bearing down on employers who hire illegal immigrants so many employers are now asking for "proper" ID from all their workers!

    Consequently, if you don't provide your social security number or any other ID, the employer could also not hire you!


  3. If you do not provide a proper W-9 when requested, mandatory withholding is required from 1099 income.  They should have really done that "before" they paid you.  Not sure what they could do now, but they could withhold what they need to from future payments if you do not provide a proper W-9.
