Workers comp ,,please answers if you know?

right now my claim is been investigated ,by insurance so right now im getting checks from the state .so if in 2 months the insurance accepst my claim .will they owe me 2 months ???of money .

  1. If you've been off work since you day of injury and they haven't paid you for your lost time and 2 months later they finally accept the claim, yes you will get your 2 months of lost wages.  Be aware there is no interest owed to you because they held it.  Likely it's a state rule that allows the insurance company to do this...I believe that Hawaii does this.

    If you get money from the state, than the state will ask the work comp insurance for reimbursement.  Remember, state rates are different than those of work comp rates.


  2. It may take more than 2months for the insurance to

    investigate your case. depends on how you were injured

    at work. I don't have any details on what happened at work

    give me some info on it and i can tell you what the insurance

    co. is up to. Back to your question the state will be payed back

    of what they give you .and you get the rest. The state will not pay

    you 2/3 of your pay so you do have some coming to you.

  3. If they accept it, and you've been disabled this whole time, yes - however - you can't double dip, so the state will be eligible for reimbursement FIRST from the workers comp carrier.
