Workers comp injury returning to work ?

PLEASE BE SPECIFIC ......I HAVE MY ATTORNEY .BROKE MY HAND AT WORK SO WAS WONDERING ,LETS SAY THAT IN 3 MONTHS I GET BETTER AND GOOD TO RETURN TO WORK .,DOES MY CLAIM STILL REMAINS OPEN WILL I STILL GET A COMPENSATION OR AND WILL MY EMPLOYER WANT ME BACK SINCE IM SUING THEM ?

Why the HECK aren't you asking your attorney?

You don't get pain and suffering with workers comp.  You only get lost wages and medical bills.  Any settlement you get, would be for a permanent disability, and/or future medical bills related to the hand.

If it heals cleanly, likely, you're not going to get a settlement.

Your employer - are you still employed by them?   If so, they'll take you back.  If not, likely not.

Well depends, you return to work on a full duty basis without any restrictions than likely you won't get very much.  If your hand doesn't heal right and you lose like sensation, range of motion or numbness than you might be entitled to a permanent partial disability/impairment (PPD/PPI).  However the value of the injury might be just $0-$10,000 depending on the severity of the injury.  In this case, if you didn't have surgery and was in a cast likely you won't get much PPD/PPI money.

If you suing your employer your technically suing the insurance company for more benefits.  I'm not sure what the story is, but if your suing and there was a hearing than obviously your claim was denied at one point.

If you return back to work your claim will remain open until your doctor declares you medically stationary or you reach maximum medical improvement (MMI).  Once that is reached than your claim will be subject to close. If you do go back to work full duty than your company can do what they want, you show up to work 5 mins late...they can fire you. Economy is down, no work avaliable, you could get laid off.
