insurance delaying my benefits due to ,inconsistent history of accident . what is my lawyer going to do to take care of this ??or whats the proccess?

  1. Your lawyer is going to slow the process down.  A lot. All paperwork is going to have to go through him.  It could be 6 to 18 months before you see any money.  IF you win your case.  Likely, there will be a hearing before a WC judge.


  2. They are trying to get out of paying you.

    Don't worry they have to pay you for the injury that you have now

    your lawyer will take care of it.

  3. Depends on whats going on with your claim.  Is the whole case being held up because the story of the accident is inconsistent?  How long was it when you got injured?  Was it recent? Has it been a long time like 2 months?

    If the injury occurred just recently than it's likely that the claim is going through a deferred status, there is no formal acceptance or formal denial. The process in this case can take 1 day or 180 days depending on where you are at.  Each state has different rules.  Since you got a lawyer it's likely that your case is going to take longer to get around with IME's, interviews and depositions.  I'm gong to assume in this case that your claim is going through a hearing process.  Getting a lawyer always shows concerns, you could be hiding something or your looking for money.  Also it can mean that the claim has been denied and your going through the whole hearing process.

    If your claim has been open for a while now, than I'm going to assume that it's been denied.  Your claim will go through a long process of depositions, IME's, hearings, mediations and delays.  

    You'll have to continue to be patient, your lawyer has other cases. Make sure you keep in contact with your lawyer and not your adjuster.  Be prepared for a long tough few months.
