Workers comp state disability question?

i been getting state disability ,cause of workers comp .injury as you know is because insurance is Deng claim .so according to the guy the works for my attorney he said that that money from the state is not need to pay back cause is part of my benefits that i have paid with my taxes so why has people here said that i will need to pay the state back so am I'm paying back the money or no?

  1. It all depends on where you live, there are some states such as Washington that has workers compensation through the state itself. For instance if you are losing time from work the state is paying you for your lost time as well as medical benefits.  These states are often referred as monopolistic insurance, in which the state or government foresees workers compensation claims.

    Now if your claim is denied or deferred and your getting temporary benefits from the state until a decision is made on your claim, thats a different story.  Once your claim is accepted than you will have to pay the state back the money, usually they'll let the insurance company know.

    Again, it all depends on where you live


  2. Ask the guy next to you.

    Seriously, you can't "double dip".  If you get back pay, after winning this case, you will see that the amount for the time paid by disability, will be subtracted from the workers comp payout.  

    REgardless of how many policies you have, you can NEVER collect more than 70% of your lost wages, under any combination of disability or workers comp policies.  Even if you have 10 policies.  

  3. Money comes from employer not from employee, that is why they will want it back.
