Would I get my vacation pay if....?

My employer gives vacation time based on hours worked starting January 1st of every year. I started in August of last year which means this year I only had 4 days of vacation time. Coming January 1st, 2009 I will have 2 weeks of vacation time saved up. However, I am looking to leave my job and re-locate somewhere else. Because of this, I would rather have the money than the vacation time.

If I leave my job right before January 1st would I get paid all of my vacation pay for the time I didn't take off? Or should I wait until after Januray 1st to get my vacation pay? What would be the best way to do this?

  1. check your employee handbook. i just answered a question similar to this and people do not understand that it is not mandatory for all companies to pay for unused vacation time.

    the link below shows which states must pay for unused vacation time.

    and in your situation, if you leave before the 1st, you will be paid for the time earned up to that point. if your 2 weeks kicks in after the 1st, you would have to stay until after the 1st.  


  2. There is no federal law concerning pay out of vacation time, you would need to check your company handbook to see what your company policy is for this.
