Would I have a case against my apartment building?

I was taking my dogs out the other day and I accidentally shut the door too fast and cut the back of my ankle open on this metal door lip that they have on there doors.. Its so bad that I had to have surgery and cut 60% of my Achilles tendon. Could I sue my apartment building for lost wages and medical bills? Does anybody know?

  1. The building has liability coverage for that very reason.  Go ahead and contact you apartment building and inform them of the matter.  Did you make a police report.  The door is obviously dangerous.  Go to an attorney and make a case.

If the door was in poor condition and needed repair you might have something to go on.  I can't imagine that a door in GOOD repair would have caused such an injury.  You are paying to live in the building and the owner has a legal obligation to keep their tenants safe from harm (as far as the condition of the building).  I would talk with a licensed attorney in your area who would be familiar with the local laws.  Be careful not to find yourself one of those attorneys who would sue the sun because of a sunburn though.  They are boud to take you for everything you have even if they dont' have a leg to stand on in court.

    Also, keep in mind, the first thing you need to do is take pictures of the door and make sure you keep all medical records.  I hope that you informed the medical staff where you received the injury and that it is documented in your chart.  Oh, and check the statute of limitations.  I'm sure you have ample time, but not a bad idea to know excatly how much.

  5. You cannot sue your apartment building but you can sue the owner of it. It sounds like it was a dangerous door - a normal door should not have injured you so badly.

    Good luck with the surgery and recovery. I tore my achilles 18 years ago and it is no fun at all.


  6. If you can prove that the material that cut your tendom was due to neglect, you can file a civil suit against the owner.
