Question:

Would I have to move out if I take my landlord to court???

my landlord is trying to make me pay back fees from an old management agreement, but nothing in the apartment never gets fixed, air, doors, k***s, cabinets, sockets and I also have an ant infestation which is not something I want with my newborn in the place I've told them plenty times before and have pictures , would i have to move out???, and if so can I get reimbursed??

  1. Reimbursed for what?

    Sounds like you owe the landlord money.

    You can't stop paying your bills and be expected to have a place to stay.  Ants only stay in places where they can find food...primarily sugar, so you need to figure out where you are leaving it.

    He isn't under ANY legal obligation to keep renewing your lease.


  2. I'm not sure what you mean of the back fee. If it's your responsibility to pay, the LL has right to ask you for the money. For the things you request your LL to fix, you have to put it in writing. Somethings that might make the place uninhabitable the LL has to fix it as required by law such as water heater, a furnace, leaky roof, lock on the door and windows, etc. You need to show to the judge that those are required by law your LL has to fix and repair otherwise it's uninhabitable. And you did requested in writing many times. If you can show evidences and win, you are protected by law from being retaliate by your LL for at least 6 months including he can't raise the rent or ask you to move.

    This is the law in CA though, check with you own state's law.

  3. I went to a class given by the local Small Claims Court judge.  It was fascinating.  He says that , if you have complaints about your landlord or the bugs, come to him first.  He will make the landlord fix everything. You fill out 1 paper ( a 10 day notice) and you are done.  

    But the judge said that you can not refuse to pay your rent and then come to the judge to complain.  That makes him mad. /
