Question:

Would I owe him money?

I owned my house before I remarried. Its almost paid for. I've been married for 7 years. If I were to get divorced now, would I owe my husband anything for whatever he contributed towards the house during our marriage? Also, how could I get him to move out if he doesn't want to leave. This is in Pennsylvania. Thanks.

  1. As far as getting him to move out, most states have domestic abuse laws that require a spouse to leave if one doesnt want him there.

Some states like california and tx are joint property states and require you to split the house.  I don't know about PA

  2. I don't know about Pennsylvania but in California, which is a community property state, he would be entitled to 1/2 of any appreciation that occurred during the marriage.  NOT 1/2 the house, just 1/2 of the appreciation during the marriage.
