Question:

Would a doctor report their patient doing this?

The patient, age seventeen, enlisted an eighteen-year-old friend to buy the drug Plan B for her so she wouldn't have to waste time obtaining a prescription, which is required for anyone under the age of eighteen to purchase Plan B.

If the patient confessed this to their doctor, would the doctor be obligated, or even allowed, to report it to the authorities? Or is there some policy of confidentiality that prevents them from doing so?

I've already found out from my other question that the friend would be the one most harshly punished.

Again, only factual answers, please, and no criticism. Thank you.

  1. Doctor-patient privilege does not protect the 18 year old.  The doctor may disclose the prescription fraud and in some states he may be required to.

BUT - the doctor does not have to reveal that the 17 year old is using Plan B.  That would be confidential, even if patient got it illegally.

  2. The eighteen year old is guilty of furnishing medication without a license.  The seventeen year old is guilty of solicitation to commit an illegal act.

Th physician is under no obligation to maintain confidentiality in a case where the law is being broken.

The physician can be held accountable if there are physical complications from the inappropriately dispensed medication and he/she did not report the incident.

Physicians, depending on the state they are licensed in, are required to report possible misconduct.
