Would a misdemeanor come out in a company background check?

I got caught with 2 ounces of marijuana...i have also applied for a job and the last thing i need is the background check. would that come out even though i have not been to court to plead guilty or not guilty?

If I read your question, this sounds like a pending case.  If so, then it is fair game for a background screening company to report it to the potential employer, unless your particular state prohibits it.  The only state right now that does not allow this type of case to be reported is MA.  Even if you are convicted, MA Fair Credit Reporting Act prohibits a consumer reporting agency from disseminating this conviction to the end user.

  3. No it will not come up as you have not been convicted yet of the crime.  You are innocent until proven guilty.......once you are convicted (if you are) then you will have a criminal record.

  4. I think they only look for felonies.  I think as far as contacing people, they call call your company and ask the dates you were employed, but I don't think they can ask anything beyond that.

  5. It depends on the company, who does their background checks, and what the local laws may allow or not allow.  I'd say you have a 50/50 shot of getting busted.  And if you're not busted now, you will likely be in the future.  

    If you want to work the kind of jobs you need background checks for, you gotta quit the pot or find a company that doesn't care.

Everyone is wrong with the exception of Rob and Lori.  Background checks normally also includes a criminal background check.  As poster Rob stated it does depend on the organization and how thorough they are and most organizations including a position for a cashier at Target are very thorough.  If they do in fact conduct criminal background checks trust and believe the misdemeanor will come out.  However, I will add as poster Rob stated.  This also depends on your state laws.  There are a small number of states that do not allow these types of checks.  Keyword:  Small number of states. You can hope you are in this group.
