Question:

Would a speeding ticked be invalid if the officer wrote it on an expired ticket?

The local district justice called me to tell me they were sending me a new speeding ticket since the officer who gave it to me mistakenly wrote it on an expired ticket. The district justice's office asked me to sign the new one and send it back, but since the old one was invalid, if I don't sign the new one, shouldn't it be thrown out?

  1. What is an expired ticket?  They may have used an old form, but tickets DON'T expire.  Signing the new form only acknowledges you received a copy.  The citation is valid with or without your signature.

Tickets don't expire.  If you fail to sign and pretend you never got it, then you would end up not paying the fine, which would result in a late fee at the least, and if you still didn't pay, then you would have a court date, and then if you miss that a warrant for you arrest, which is pretty lame for a speeding ticket.

  6. I believe it  should be thrown out. One thing I wouldn't do is sign it. See a lawyer. I think it's worth it.

  7. I would destroy the new one and claimed that I never got it, don't sign ANYTHING THAT WOULD SHOW THAT YOU RECEIVED THE NEW ONE. It wasn't your fault if it was written on an expired ticket, the Motor and Vehicle Dept. must pay more attention on the stationary they provide to officers so it's their fault!
