would i be violating a restraining order if i contact my ex whom i have a restraining order on ? the short version is this tale is that my ex whom we've dated for short stints dating back from 2000-2002 each sting only lasted around a month thats because she had a bad drug problem with Marijuana and i still believe that she does i use to give her money and feed her habit because i wanted s*x in which i never did because she always outsmarted me or sometimes had me robbed which marked the end to every relationship stint we had now its 6 years later she moves alots but now she is back in my neighborhood she've recently spitted on me at a public place she is very ghetto she has been constantly harrassing me until the point when i had to get a restraining order on her just this year may 2008 she did not showed up to court so right now she does not know there is a restraining order against her the judge told me when i see her to call the police however i had not seen her in a while and i know that if she sees me she will try to fight me and i dont want her to get arrested so i want to send her mom or sister a letter and write that i want her to meet me at a restaurant alone so i can find out why is she attacking me my family and nobody knows im thinking bout doing this but i think this needs to be done before i get into a new relationship i want to talk to her alone would this violate my restraining order i have against her and can i get in trouble for this ?

  1. Every State or County government has different rules on these. You should contact the court system that issued the Protective Order to find out before you do anything. Without seeing your actual order no one on here could really tell you for sure and we wouldn't want to get you in trouble.


  2. She could/would be arrested if she meets with you, and you could be arrested for conspiracy to violate the restraining order.

    You can check with the court to see if she was ever served the restraining order.

    You family should have been named on the protective order. Go to the court and ask to get the order amended to include your family members.  

  3. Yes, the restraining order protects both you and your ex from harassment.  If you violate the restraining order by contacting your ex, you could get in trouble.

  4. Sounds like you are looking for a lot of trouble, legal and otherwise. Judges don't give restraining orders out only to see them abused by the petitioner. This person could report to the court that she had permission from you to see her--that you requested she invalidate the restraining order for a period of time--which is not something the court would take lightly.

    I don't know, but that could end you up in hot water with the court and the restraining order being vacated.

  5. yes the restraining order works both ways, you can not contact him and he may not contact you.  You can drop a restraining order if you wish though
