holes on walls. Broken handles, broken closet mirrored door. House left dirty, be considered wear n tear? My tenants rented for a year, and now claim that it's wear and tear. Please give me your advice.

Nope, I would not consider that wear and tear....that's abuse.  My mom has rental properties, and it seems that every year, the tenants get worse.  Doesn't anyone have any respect anymore?  I'd take pictures of the mess they left you and take them to court!!!  Good luck, and I really feel sorry for you, because I know what you're going through.  Makes you wonder if its worth having rental property, doesn't it?  The laws for eviction are made for the criminals too!  Its ridiculous!


  2. Normal wear and tear means just that. The property should have been left clean, the refrigerator empty and clean, the stove clean and any damage repaired.  If the walls have holes in them, that is damage, torn carpet is damage, worn thin is not. Walls should be clean, but not painted by the tenant.  Broken handles may be debated, call an attorney after you have photographed all of the area. You do have a damage deposit don't you?  Hold off on doing anything except the attorney and photos  until you get your attorney's opinion.  A lawsuit is your last option and never a winning solution.  Typical condition should be ready to clean the carpets, paint the walls and rent the unit. Any more than that and the landlord is loosing, if the tenant left the place clean and undamaged but used not abused then the deposit should be refunded.  Call an attorney, take the pictures.  

  3. no, normal wear and tear, can be compared to a normal family. a carpet should last maybe 10 years.  Damage to appliances, shows capelessness.

  5. if it is dirty they should of cleaned it before moving out.you can deduct money to have a cleaning woman come in and do the job.and what needs to be replaced just buy the stuff like the handle the broken doors get them fixed save all your reciets and take pictures that stuff is not wear and tear.the holes in walls from pictures is wear and tear but that is about it.when the other stuff got broken they should of contacted you so you could of replaced it.that would of been the right thing to do.not move out and leave the apt in that kind of condition.
