Question:

Would this plan work and if so is it legal?(from what i've checked it is legal but I'm not sure)?

Would this plan work?

Right me and my girlfriend want to marry and then live together in the US afterwards, she's already a US citizen and lives in Texas in the US where she was born and raised, the only thing is if we got married we'd be a g*y marriage so i wouldn't be eligable for a Spousal Visa, but I'm not a woman YET.

Now I'm only 15 and me and my girlfriend are only planning for the future but I'm a pre-op male-to-female transsexual. Now from October I'm gonna start my journey to becoming a woman, but until my passports are change and that which the way I see it should be my choice when it happens I'll still be classed as a male and if not and could explain things to my Doctor and I'm sure they should understand my situation, marry my girlfriend as a male, apply for a spousal visa, do all the other stuff that needs to be done to declare me a US citizen, then once that's done, come to the UK, see my doctors again, have the rest of my surgery done in the UK, have my records changed and everything, then come back to the USA as a US citizen, renew my marriage with my girlfriend and then spend the rest of my life with her in the USA.

Would this plan work?

As far as I know, it breaks no laws and has no forms of fraud but i could be wrong.

Is this plan legal and would it work?

I really love my girlfriend and I want to spend the rest of my life with her and realistically and legally i see this the only way possible.

  1. Sorry, I should have mentioned: after having become a US citizen you would presumably be living abroad and future surgery (even with a dual citizenship) would no longer be provided by the UK NHS so you would have to pay for the rest of your treatment.

    Your case is quite special and could be dealt with in a number of ways. You're only 15 at the moment anyway (don't worry, I'm not going to give you  lecture on forward-planning) and there are quite a few years before you are likely to get married, during which time, with pressure from abroad and changing mentality, Federal law in the US might change to accept g*y marriage, making the whole thing a lot simpler (but also making planning ahead more difficult).

  2. g*y marriage is not recognized by the government and you must both be 18 when applying for a green card.after marriage you must wait 3 years to be able to apply for citizenship and you must not be out of the country for no more than i think 2 years and no more than 6 months at a time.

    i answered with immigration facts trying to not give my opinion.because if i did you would not like it! no you cant do that.at the immigration interview they will see your s*x change.if appling before 2 years of marriage you would get a conditional green card and will have to do a second interview to remove the conditions.they will think it is a scam and you will be deported.green card holds no security from deportation.they will not see your marraige as valid, but as a scam.they are not dumb!

One HUGE flaw in your carefully thought out plan: You are only 15...I hate to say this, but you are in the early stages of puberty...you will change, like it or not...maybe not your sexuality, maybe not your love for this girl...but the chances that you will still feel the same about both in a few years time are remote, at best.  

  4. I am worried that you made such a drastic commitment as s*x change  and marriage at your age, and worse, your parents went along with it.   I Hope that the hospital gave you conseling prior to agreeing to such a thing.

    This is something to be fought out in the courts.  It's a gray zone.   YOu could hold off on the s*x change.  That would give you a better chance.   Immigration would look at it suspiciously when they find a woman when tehy interview you.   A green card is not a promise that you can stay.   Immigration might not see it as areal marriage and kick you out.

    edit:  Law is different in different countries.   IN the US, I beleive all s*x changes require a Psych counsel prior to the surgery.   THis is handles through the hospital that the surgery would take place.     Remember, this surgery is not free in the US.

    I do believe there is a hospital in Texas that does do s*x changes.  I believe in Galvaston, but I'm not sure.   If I was you I would move to that city.  Ithe city is known to be accepting of your life style.

    I'm not  sure about England, but a psych exam seems standard prior to starting a s*x change treatment  for the entire world.

  6. heres what I see wrong with this plan.

    If you get the green card in a male name - it will NOT be easy for you to change the green card and all other documents (SSN etc)  to a female name after you have finished the treatments.

    Because you would be living in a g*y relationship and the US federal government does NOT recognize g*y couples or g*y marriage. And is your girlfriend g*y?

    Or is the plan for the two of you to split up after you have your green card?  Because if that is the plan then you are essentially planning marriage fraud and the US govt hates marriage fraud. People have had their green cards revoked for marriage fraud.

    I think you need to think this through a bit more carefully.

  7. The plan sounds ok but it will take years before you are able to change your passport.

    You say your "journey" is starting in Oct, would be interested to know which doctor is willing to begin this sort of procedure with a young boy who is still growing and has no parental support (you said mum doesn't understand in earlier question).

    If you are serious, what's the rush, you're young and feelings can and do change rapidly at this age.

    I do not know where you think you will start your operation into becoming female, but the majority of countries do not allow it until maturity or after 25 from what I have read.

    Texas does not recognise g*y marriage.

    How can you marry someone that you cannot support?  

    How old is this 'girl' you want to marry?

    You should wait until you are out of college and can AFFORD to play house.

    Just telling you once you leave mommy and daddy and move to another country as a transexual you are open for a RUDE awakening.

    You are moving to a place that is what we call a Bible belt.  They dislike g**s and homosexuals in many areas.  You will be made fun of and mean things done to you.

  9. Flaw 1) Once you get your US citizenship you will stop being eligable for NHS treatment.

    Flaw 2) If you are a US citizen then you will not be able to change your papers in the UK, it would have to be done in the US because it would be a US passport. You need to check the US law on this.

    Flaw 3) Just getting married will not get you US citizenship - i'm sure you will have to live in the US for a while first and there may be other criteria

  10. If you are between 16 and 17 years old, you may apply for a marriage license in Texas only if you have written parental consent on an official form in the presence of the county clerk or if you have received an order from the Texas district court authorizing your marriage.
