hi.. a month ago i gave a guy $1020 for a car, but he never gave me the car.. he gave me a receipt saying that i bought the ca from him.. i don't have the car or the money.. now how can i sue him? what steps do i need to sue him.. although he had me going for a month for the car and he never gave it to me.. so help please. tell me how to sue him?

  1. contact a local lawyer who offers free conseltation...he should instruct you further  


  2. You gave him the money without getting the keys handed to you! Do a web search for a famous saying from P.T. Barnum.

    Check with your local court house for the procedure to file a claim in small claims court.

The first thing I'd do is go to the police and show them the receipt.  They might go to his place and force him to give you the car, or they might direct you to go to a lawyer, or just give you some advice.  At least all this will be free until you get to the lawyer. In essence, he has "stolen" your car. Good luck.

  4. sounds like you were scammed, first go to the police and file a report, make sure you have the receipt, after an investigation is complete you can take him to small claims court.  

  5. Without knowing what country you are from, it's difficult to give accurate advice.

    This may be something that belongs in the petty sessions court because of the small amount of money involved - give one of your courts or a free legal advice line a ring and ask them - you may be able to do all the paperwork yourself and have a friend/relative serve any necessary papers on the guy - that will save you the service fee.

    I hope the receipt has either the registration of the car on it or the name and address of the person you gave the money to and that the payment was for a vehicle - a date would be good too.  It should also have your name and address on it.

    With that kind of information, especially the registration, you should be able to prove, with assistance from the Vehicle Registry, that you have never transferred a vehicle from his name to yours.  That may give you a strong case.

    Why on earth didn't he give it to you right away???  Or at least the keys?  Do you think he was trying to con you from the very start?  (It wasn't a case of, "He's my mate/relative - he won't con me" was it?  I've learnt from bitter experience that I should only trust my parents and one or two VERY close friends.)

  6. Sounds like you need to go to civil court and talk with someone there.  

  7. You need a lawyer to go sue him. Yes, this would be undelivered goods and is a crime. Get with a lawyer and they will be able to answer you way better than someone on here. My only advice, only take actions under legal council, if you take stuff into your own hands you may never get anything done.
