Would you rather be ARRESTED for having s*x in public, or for assault & battery?

before anyone jumps the gun on me, let me justify myself by saying that this is just an extreme, yet more realistic scenario of the age old question of if you are "a lover, or a fighter".

  1. It would depend on where I was located.  In some states, such as Arizona, indecent exposure and/or lewd conduct are classified as s*x crimes, and conviction can require registration as a s*x offender FOR LIFE!  Every year at spring break a couple of elementary ed majors from ASU get busted for being naked and that's their career down the tubes.  Plus whenever they move they get to go meet the neighbors by introducing themselves as s*x offenders.  Here's a funny aside: in AZ it's illegal to have an erection that can be seen through your clothes!  All those junior high boys in gym class are breaking the law!

    Assult and battery, on the other hand, is almost always a felony and usually has mandatory minimum sentences.  You're going to jail, but sometimes for a surprisingly short time (30 days).  A good lawyer and good behavior can make this a blip on the radar, although you'll have to explain yourself on every job application for the rest of your life, and if you rent you might have trouble finding a place to live.

    I know this isn't what you were asking, but determining which I'd rather be arrested for is more a question of which punishment I'm more willing to endure.  I'm sure everybody would say they'd rather have s*x than get into a fight, but that's not the question.  Let me assess the laws in whatever locale I happen to find myself, and then I'll tell you for sure.  Probably s*x in public, although in AZ I'd have to say assult and battery.  I was a golden gloves boxer and am already pretty heavily tattooed, I can handle a short stay in the pokey.

  3. This is too easy since I love having s*x in public, in a discreet way... and have done it quite often. I am way overdue on getting caught. I do not believe in violence, I don't even yell, much less hit.  

  4. Unless you totally dominate and kick the other person's ***, fighting is rarely a pleasant experienc.

    But s*x, on the other hand, is more than likely going to be something you enjoy.

Being arrested for having s*x in public would be embarrassing!  But being arrested for hurting somebody would be a much worse charge and you would spend a lot more time in jail  So,of the two, i guess I'd have to choose being arrested for having s*x in public--and hope none of my friends (or boss) read the paper the next day!!!

  8. I'd much rather be arrested for having s*x in public than for assault & battery. It's the less serious offense & the one that I'd rather be involved in (as it doesn't carry any connotation of violence).  

  9. Definately the former.... for two reasons.

    1st I get to have s*x which is always nice, and in public is fun too.

    2nd lude conduct carries a far less punishment then does assault & battery.  You don't go to prison for having s*x in public, you do for assault.  Bail is also cheap and immediate.

If my reasons for commiting these "crimes" were justifiable, then I wouldn't feel ashamed of being arrested for either one.  For example, if I were head over heels in love with someone I wanted to spend my life with...and we seriously believed  we were alone, but then got caught...it might be something we could laugh about in our old age.   If I saw someone causing harm to a child, lost my cool and committed assault & battery, being arrested for the act would mean nothing to me.

    But if the reasons were not justifiable, well then, I guess I'd rather be known as a s**t than a cruel person.

    I'm not sure it matters if you're a lover or a fighter, once you're a jailbird.
