Question:

Wrong name in traffic citation / ticket. am I off the hook or does this give me better chances at court

I got a moving violation tonight (not slowing down at a flashing yellow). However, the name on the citation is not mine and the address and DL number is incorrect. When i say incorrect I mean they have the name and address of a totally different person. the only thing it has correct is my vehicle information.

Any chance that I am off the hook with this since they have somone elses name on the citation #?

If not does thsi give me a goood chance of beatign the ticket if I hire a lawyer?

  1. --- To answer this question I would first have to know HOW and WHY the wrong name and address got onto the citation in the first place.

    --- Was the citation issued to you in person, directly? Or was it mailed to you based on a photo violation detector?

    --- Was it the result of a false DL or someone elses DL being given to the officer?

    --- Without knowing that no one is going to be able to give you an accurate answer.

    EDIT:

    --- If you presented him with your license and in no way misled him and he got all that basic information wrong then a person would have good chance in a trial by challenging his competency.

    ---If he can't even write down the right name, etc from a license then perhaps he would have trouble writing an accurate report of the event too. Perhaps he would have trouble even observing the event.

    ---In other words a lot of hay could be made out of how and why he got all that information wrong and you could maybe even convince the judge he was incompetent. Though it would be better handled by a attorney in a court trial, you could do it yourself if you study the process a bit.

    --- Also, you could appear for the court date and get a pre-trial conference and show it all to the city attorney or DA. They might even dump it before a trial because it is so incompetent.

    --- I say this because I can't stand dunces who get into police work, BUT I have not heard his side of it yet either. I can't think of a valid excuse for what he did beside incompetence but maybe he has one. That is why you should get a pre-trial conference and see what the DA has to say when you show it to him. Maybe there was some valid excuse, but I can't think of one myself.


  2. You were handed someone else's ticket.  If you signed the right ticket, a warrant will be issued for your arrest if you do not pay the ticket.

    You can always contest, and being handed the wrong ticket give you a better chance than usual, but don't go celebrating yet.

    You could get lucky if the issuing officer realizes his mistake and does not turn either of them in.  Wait 1 week, then call the court and see if you even have a ticket.

    I think hiring a lawyer is bit overkill....hire a lawyer for 500 bucks to beat a 100 buck ticket?  Common sense here...

  3. Plenty of chance you will have "your" ticket dismissed in court if you play your cards right.  Get some real awesome advice on how to behave in court and how to prepare for the court on the blog spot.

You really don't need a lawyer its just a waste of money.  I had the same problem.  The cops put it on me when it was my brothers speeding ticket.  Went to court just to claim "not guilty."  Set up another court date, came to that court date and the cop showed up with the tape.  Turns out he made a mistake and dropped the case then and there.  Its a cops mistake so they just drop the case. BUT in your case just show your I.D. since they put it on someone else and they will just drop the case.

    Sadly if they know your vehicle information then they would get the correct address from who em ever sold you the vehicle.

    Soooo Just hire a layer, and tell him about the mistake. He might find a good hole he can use in the court. Like, for example

    "if the information on the ticket was incorrect about the address, why cant the information could be wrong about the car?" haha that should work
