Wrong social on the ticket and c**p for probable cause?

i was doing 30 in a 30 after droping off a friend. a cop pulled me over and his reason for doing so was because he had reports of people walking and banging on doors in the neighborhood. i had a warrant for missing a court date that i had not been imformed of(for traffic ticket) and my lisence was suspened. he searched my car and found a half ounce of pot and a pipe. the car was my dads and ended up not having insurance. did he have probable cause to do so without asking. and can i get out of this because he got personal information like my social # on the ticket

  1. If he was investigating suspicious activity call - his PC and stop are fine.  His search incident to arrest is not a problem

Good question...I think here in Canada you have a strong case for illegal search and seizure, I'm not trying to farm points but I am really unsure as to the correct answer, I'm just interested in seeing some other responses....I'll give you a star for this questions...others please dont thumb me down

  3. The gentleman ID'd as "Trooper" is absolutely correct.  My only comment to his answer is that I have trouble rationalizing how an officer could stop someone driving a vehicle simply because it was in an area where people were "walking and banging on doors".  

    With the info we have, the officer could argue he could stop every vehicle in the area.  That' s not reasonable suspicion.  That's a fishing expedition and isn't reasonable.

    With that being said, if the stop is found to be unreasonable, then anything found based upon the stop should be suppressed and charges ultimately dismissed.

  4. You don't need probable cause to stop a vehicle, you only need a reasonable suspicion. If he suspected you were involved with banging on doors, and that suspicion was reasonable, the stop is valid. He doesn't have to be right, just reasonable.

    Once he discovered the warrant, the search was then legal, because it was incident to your arrest.

    As far as the wrong SSAN, that will not matter. Mistakes do not void tickets. Your name and date of birth will be enough to identify you, so the ticket will stand.
