Question:

You cant be served for credit card debt unless you are served by the sheriff???

Basically if they have not served me or anyone in my residence they cant start a court case against me???

  1. It depends on your states service laws. In some states a regular process server, publication, sent by mail, taped to your door, etc. will do.

    If your states rules of service require people to be served by the sheriff, then it must be served by the sheriff.

    Also, since there is quite a bit of "sewer service" that happens, it would be up to the person being sued to make sure they were properly served and take the steps needed if they find they were sewer served.


  2. Maybe you are thinking about debtor's prison, which is outlawed.

    As for a credit card debt, you can be sued.  Usually they'll just use a collection agency, ruin your credit, and thus, ruin your life for the next 7-10 years.

    What is credit?  It's basically using someone else's money to buy something that you can't afford at the moment.  You pay interest for the privilege of borrowing that money.  Now, if you borrow money and refuse to pay them back, they ought to have recourse to get that money, right?  If someone borrowed money from you, would you forgive the loan if they decide to not pay you back?

  4. Well...it has to be some sort of notification by an official.....They can't serve you by sending a regular letter for 43 cents. It's almost always a sheriff or some sort of government official.

  5. The rules for serving a summons can vary from state to state and even court to court, so it's really hard to give a sure answer here.

    In some areas, if they are having trouble locating you or know that you are dodging the summons, they can do an "alternate service" such as posting notice in the newspaper.
