Unless the other person is legally allowed to claim them, then it's illegal and you should contact the IRS.  If you'll give a little more info about who this other person is - are they related or not, did the child live with them - and finish your question, you'll get a better answer.

If someone else is claiming your child as a dependent on their tax return...you need to contact the IRS right away.  Otherwise, YOU could be penalized.

This happened to my daughter, she had to pay back IRS, and the investigation is still on going...but that did not stop them from garnisheeing her wages. They took 100% of her check she was to recieve from the state.

How old is the child? Have you ever claimed them? You would have gotten more than the $300.00 economic stimulus payment if you could have claimed her yourself. Did the person steal her s.s.#  You need to report the fraud. If the check has already been issued to someone else...It's going to take along time to get your money....if ever.

Only if the child doesn't live with you. I am on disability. My youngest gets a check even though he lives with his mom & she claims him on her taxes.
