"FCO Final Court Dismissal - Failed to Appear" - Are the parties no longer married?

In a friend's divorce record online, through the county court, it states "FCO Final Court Dismissal - Failed to Appear". He is very much for the divorce, however, his ex is the plaintiff, and was the one scheduled to appear. When a divorce case is dismissed, does that mean the parties are no longer married? Also, on the site, it says "Case Disposed 8/12/08". Please advise. Thanks!

  1. If the case is dismissed, it means that no divorce was granted, at least not based on the specific case.  For a divorce to be official a divorce decree has to be issued by a court.

    It just says no one showed up.  They cannot conduct a proceeding if no one is there to present their case.


  2. It means the case has been dismissed and no divorce was entered. He should file as the plaintiff, cause it sounds like he's still married, since the one who brought the petition to court did not appear.

  3. Means it is probably waiting on recordation of the final status report and decree from the judge. Call the clerk

  4. I am not sure what state you are in, but a dismissal does not equal a divorce. It means the case was dismissed, and probably has to be refiled. He could have shown up to court, even though he did not file, just to assure the courts he wanted to go through with the divorce. i would have him go to the court and speak to a clerk, or get a copy of his court papers from the clerk and contact a lawyer or legal aid office to help him decipher it.

  5. Your friend IS still married, since neither party demonstrated an interest in continuing the case.  If either party had shown up the case could have been settled instead of being dismissed.

  6. It sounds like they are still married. Since the plaintiff didn't show up they just threw the case out. One of the two parties is going to have to re-file. It should have said the marriage is hear-by dissolved, or something similar.
