Question:

"Romeo and Juliet" laws of Maine?

Does anyone know if Maine has any "Romeo and Juliet" laws? I heard that some states have them regarding statutory rape where if the actor is less than a specified number of years older than the "victim", no crime has been committed, or the penalty is far less severe. If a 15 year old male in Maine has s*x with a female only 7 months younger than him (say she was 14 at the time), could the male be charged with statutory rape or any other crime? Please post your sources if possible. TIA

  1. No there are no such thing as "Romeo and Juliet" laws that I have ever heard of.  Statutory Rape is rarely enforced, and when it is it's because the parents of the female found out.  You should wait...because you should know that s*x leads to kids, and do you want a kid when you are still one yourself?  No, condoms and "the Pill" are not always 100% effective.  s*x is awesome but use your head.

  2. the actor??

  3. There are very specific cases about this on the books.  In California, for example, there is an appellate case where a girl and boy had s*x, both were 16.  The boy was prosecuted but not the girl.  The defense argued that this was unconstitutional (on sexual grounds) and contrary to the intent of the statute (as the law was written to protect both children and therefore shouldn't be applied to punish a protected party).  The appellate court disregarded these arguments and upheld the conviction.  You'll have to look up the actual statute of the Main law and read the appellate opinions applying it.

Colt 45 is incorrect, there are Romeo and Juliet laws.  It just depends on the state you're in.
