my work was having me work off the clock. I work for walmart. Since we closed ealy on sun at 8pm, I was on my way out the door and my taxi waiting, my assist manager was demanding me to check a price for a customer. I told him no and I wass off the clock. He said he cant have his customer wait and it was my fault because before I clocked the page me to the front for the price check. I went there and I went okay how can i help and all the cashier did was hand me a shirt at the podioum im like ok maybe she just wants me to put away since she said no word to me. im like okay maybe someone already checked it that was 7:45. It just I had a long day and they do this to me.

  1. Next time they pull it you clock back in. If you slip and hurt yourself workmans comp won't cover you as you were "off duty".

Never do it again without clocking back in.

  2. I'm not sure how the law works for the state you are in, but I am thinking this should apply company wide since there have been so many law-suits against the co. for stuff like this. In California - we fill out a time adjustment for 15 min. (thats the legal minimum time they have to pay you for - even if it took 3 minutes) then you have that ***. manager lol sign it and if not take it to the store manager and explain to them why you are filling it out - bet they never do that again!!!

P.S WoW you close early on Sunday?

p.s.s. if you already clocked out and the manager is telling you to do some type of work - tell them you are off the clock. Technically it is illegal for them to even so much as DISCUSS work with you when not on the clock. Call the market manager and let them know. It doesn't matter if they paged you before you clocked out or not - the point being you are clocked out. He/she could have done the price check themselves and saved the customer the time of having to wait for you.

  3. If you hadn't said where you worked, Walmart would have been my first guess. They are notorious for treating their employees like that and bending labor laws.

Your manager asking you to work off the clock is illegal (although I understand the circumstances of this specific situation). You can contact someone in Walmart's HR (or maybe they have an ethics hotline) department for more information about your rights.

If it ever happens again, just leave. Your manager legally does not have that kind of control over you after you clock out. So if he says "I need you to do X..." and you say "I can't, I already clocked out." and he says, "well do it anyway"... just walk out. He knows that you have the right to sue if he tries to enforce consequences for it.
